Terms and Conditions for Events
These General Terms and Conditions for Events (GTC Events) govern the legal relationship between the guest (hereinafter referred to as the “Guest”) and Engadin St. Moritz Mountains AG as the operator of the dining establishments listed below. This applies in connection with the rental of seminar, banquet, and event venues (hereinafter referred to as “Venues”) as well as related services or deliveries to and for the customer or event organizer. Please note that these Terms and Conditions always refer to a “contract” with regard to all services. For accommodations, the Terms and Conditions of the lodging establishments apply. The General Terms and Conditions of Engadin St. Moritz Mountains AG in effect at the time the contract is concluded shall apply exclusively. The guest’s general terms and conditions shall apply only if this was expressly agreed in writing prior to signing the contract. Should individual provisions of these General Terms and Conditions be ineffective or invalid, this shall not affect the validity of the contract or the remaining provisions of these General Terms and Conditions. In all other respects, the statutory provisions shall apply. These Terms and Conditions apply exclusively to the Mountains dining establishments (hereinafter referred to as “GB Mountains”). Reservations for seminars, events, or banquets fall within this scope. The organizer’s/lessor’s General Terms and Conditions do not apply. The General Terms and Conditions are also available in English. The German version of the General Terms and Conditions is authoritative.

An offer/confirmation is clearly marked as such and must be signed by the customer and returned to GB Mountains. A quote is valid for 7 days (acceptance period). GB Mountains expressly reserves the right to relist the property for sale during and after the expiration of the acceptance period. In the event of a new inquiry, the second quote may differ from the first quote.
Prices vary by venue and can be found in the quote or confirmation for each individual event. We reserve the right to change prices. All prices are in Swiss francs, are net, and include service charges and applicable VAT. The prices confirmed in writing by GB Mountains apply.
Invoices from Engadin St. Moritz Mountains AG that do not specify a due date are payable in full within 10 days of receipt. Engadin St. Moritz Mountains AG is entitled to declare accrued receivables due at any time and to demand immediate payment. Engadin St. Moritz Mountains AG reserves the right to require an advance payment for events in accordance with the quotation: Engadin St. Moritz Mountains AG is entitled to require a reasonable advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and the payment due dates will be specified in the quotation.
If no separate advance payment terms are specified, the following rules apply:
- 50% of the total cost up to 28 days before the event
- 100% of the total cost up to 7 days before the event
Cancellations must be made in writing. The following cancellation policy applies:
- Cancellation up to 28 days before the event: free of charge
- Cancellation 28 to 14 days before the event: 50% of the total cost
- Cancellation 14 to 3 days before the event: 80% of the total cost
- Cancellation 3 to 0 days before the event: 100% of the total cost
- No-show: 100% of the total cost
GB Mountains reserves the right to specify individual cancellation policies on the quote. Changes in the number of participants of up to 10% may be reported up to 72 hours before the event and are binding. If the actual number of participants on the day of the event is lower, the definitively confirmed number of participants will serve as the basis for billing. Any additional costs incurred due to extra participants will be billed. The maximum room capacities specified by the fire department must not be exceeded.
Up to and including 28 days before the guest’s agreed arrival date, GB Mountains may withdraw from the contract without incurring any costs. Furthermore, GB Mountains is entitled to withdraw from the contract extraordinarily and with immediate effect at any time for an objectively justified reason by means of an immediate, unilateral written notice. Objectively justified reasons include, for example:
- An agreed-upon advance payment or security deposit is not made within the deadline set by GB Mountains.
- Force majeure or other circumstances beyond GB Mountains’ control that objectively render fulfillment of the contract impossible.
- Rooms or spaces that are booked or used based on misleading or false information, e.g., regarding the guest’s identity or the purpose of use or stay.
- GB Mountains has reasonable grounds to believe that the use of the agreed-upon services may interfere with the smooth operation of the business, the safety of other guests, or the reputation of GB Mountains.
- The guest has become insolvent (bankruptcy or garnishment) or has suspended payments.
- The purpose or reason for the stay is unlawful.
If GB Mountains terminates the contract for the aforementioned reasons, the guest is not entitled to compensation for damages. Furthermore, payment for the booked services remains due in principle.
To discuss the details, please schedule an appointment in advance. To ensure that the event runs smoothly, all important information (e.g., equipment, menu selection, schedule, entertainment, etc.) must be provided to GB Mountains no later than 10 days before the event. Both parties must strictly adhere to the agreed-upon program times.
In exceptional cases, GB Mountains is entitled to make last-minute venue changes for events without prior notice. In any case, GB Mountains reserves the right to provide a venue appropriate for the number of participants and the nature of the event if attendance is lower than expected. Outside the rented premises, reception tables, promotional materials, banners, etc., may only be set up in consultation with GB Mountains. If public areas are to be used as part of the event, this must be discussed with GB Mountains in advance. Smoking is prohibited in all buildings owned by Engadin St. Moritz Mountains AG.
GB Mountains reserves the right to make changes to the menu and adjust the vintages of the wines.
As a general rule, the event organizer and their guests are not permitted to bring their own food and beverages to events. Exceptions require a written agreement with GB Mountains. If guests bring their own wine, spirits, cakes, etc., a service charge to cover overhead costs will be added to the total bill. The amount is specified in the event contract.
The installation of decorations or other objects requires a permit, including for fire safety reasons. Any damage caused during setup, etc., will be billed to the organizer. Parking is usually available at or near the event venue. Unless otherwise agreed, the organizer or the individual participants are responsible for any parking fees incurred.
To the extent that GB Mountains procures technical and other equipment from third parties on behalf of the organizer at the organizer’s request, it acts in the name, under the authority, and for the account of the organizer. The organizer is liable for the careful handling and proper return of such equipment. The organizer indemnifies GB Mountains against all claims by third parties arising from the provision of this equipment. The use of the organizer’s own electrical equipment connected to GB Mountains’ power grid requires prior approval. Any malfunctions or damage to the technical equipment resulting from the use of such devices shall be borne by the organizer, unless GB Mountains is responsible for them. GB Mountains may record and bill the resulting electricity costs at a flat rate. Malfunctions in technical or other equipment provided by GB Mountains will be remedied immediately whenever possible. Payments may not be withheld or reduced unless GB Mountains is responsible for such malfunctions.
The organizer agrees to comply with GB Mountains’ fire safety regulations, particularly regarding the keeping of escape routes clear, and guarantees that all materials brought onto the premises comply with fire safety guidelines. The use of flammable items is strictly prohibited.
Deliveries and pickups for events must be coordinated with GB Mountains and notified to GB Mountains in writing well in advance, at least before the items arrive. GB Mountains reserves the right to refuse shipments without a sender or a valid recipient, including details of the event. GB Mountains disclaims any resulting obligation or liability. Since storage space at GB Mountains is limited, GB Mountains may refuse to accept materials prior to the event date. For shipments from abroad to Switzerland, customs duties and value-added tax (VAT) are always incurred in addition to shipping costs. If the carrier is unable to provide the exact costs upon delivery, we reserve the right to charge a flat fee of CHF 150 to the organizer’s invoice.
For events featuring music, please note that after 11:00 p.m., music is permitted only at a moderate volume. DJs and bands are required to keep bass levels low and to cover the floor beneath their instruments with a carpet to dampen sound. The maximum performance time is until 2:00 a.m. Failure to comply with these instructions will result in additional costs being charged to the event organizer. The event organizer is responsible for clarifying and paying any copyright fees associated with musical performances. If an event lasts longer than the legally permitted curfew, a nighttime surcharge must be paid. Any request to extend closing hours must be submitted to the venue at least 4 weeks before the event. The venue will obtain the required police permit and bill the organizer for the associated costs. Guests who are outdoors are asked to behave quietly. Instructions from staff must be followed. The organizer is liable for any complaints and potential fines. For staff working at the event, a surcharge per hour will be billed starting at 11:00 p.m. in accordance with the event contract. A separate quote will be provided for train trips outside of regular public service hours. If the train service is provided for longer than requested and contractually agreed upon, the actual service provided will be billed. Engadin St. Moritz Mountains AG decides whether to operate additional trips. If an additional trip is not operated (due to weather, technical malfunctions, etc.), no claims may be asserted.
The “General Terms and Conditions for Accommodation” apply to guest room reservations. For events involving overnight stays, the hotel must receive a room list from the event organizer no later than 14 days before the guests’ arrival, containing the following information for each guest: first and last names / check-in and check-out dates / payment terms. In the event of a block reservation without a room list provided by the event organizer, guests must book the hotel rooms directly and guarantee them individually using a valid credit card. After the deadline set by the hotels has passed, any remaining available rooms from the respective block will be released for general sale. The organizer is liable in all cases for unpaid costs associated with rooms booked by its guests and their food and beverage charges (no-shows, etc.).
The guest must use the premises and materials provided with the utmost care. The organizer is responsible in all cases for any property damage or loss that occurs. GB Mountains disclaims all liability for theft, damage, and services provided by third parties. This also applies to personal injury, unless such injury was caused by GB Mountains employees. GB Mountains is liable to the extent permitted by law.
In addition to the “Event Terms and Conditions,” other provisions and booking conditions may apply, which take precedence over the “Event Terms and Conditions.” Any changes or additions to the accepted offer or to these “Event Terms and Conditions” must be made in writing. Unilateral changes or additions made by the organizer are invalid. The place of performance and payment is Engadin St. Moritz Mountains AG. Swiss law applies, with exclusive jurisdiction in Maloja. Should individual provisions of these “Event Terms and Conditions” be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions apply.
Terms and Conditions for the “ENGADINcard 365” and “PIZcard 365”
These General Terms and Conditions supplement the General Terms and Conditions (GTC) of the Engadin St. Moritz Mountain Pool (ESMP).
At a Sales Outlet or Online The “ENGADINcard 365”/“PIZcard 365” can be purchased at a staffed sales outlet or online. The contracting party must sign the Terms and Conditions for the “ENGADINcard 365”/“PIZcard 365” upon completion of the purchase. Online, the contract is concluded by accepting the Terms and Conditions.
The contract takes effect upon signing or upon completion of the online purchase and is valid for an indefinite period. The validity period is 365 days. Unless otherwise expressly agreed, the validity period begins on the date the contract is concluded. The contract may be terminated at any time by providing one month’s notice prior to the expiration of the validity period of the “ENGADINcard 365”/“PIZcard 365.” Notice of termination must be provided in writing to Engadin St. Moritz Mountain Pool.

If the “ENGADINcard 365”/“ PIZcard 365” is not canceled, it is automatically renewed for an additional validity period of 365 days. A discounted rate is granted for this additional validity period (renewal discount). However, if the contract is canceled and then renewed at a later date, the entitlement to the discounted rate (renewal discount) expires.
Any other options for canceling or suspending the “ENGADINcard 365”/“PIZcard 365” are excluded, except as provided in Section 5 below. Refunds are granted exclusively in accordance with the ESMP’s General Terms and Conditions.
The ESMP reserves the right to terminate the contract at any time for justifiable reasons.
Upon execution of the contract, the contracting party agrees to pay all amounts due in a timely manner. One month before the end of the validity period, the invoice amount for the next validity period will be charged to the contracting party via the designated payment method or, failing that, an invoice will be issued. For a subsequent validity period, the invoice amount must be paid before the start of that period; otherwise, the contracting party will be in default without a reminder.
The contracting party will be in default without a reminder if he or she fails to pay on time. If the contracting party is requested to pay via a reminder due to a delay in payment, CHF 15.00 will be charged. In the event of debt collection, additional collection fees may be charged. In any case, ESMP reserves the right to charge the applicable default interest in accordance with Art. 104 of the Swiss Code of Obligations (OR) from the due date. ESMP reserves the right to assign its claims to third parties. If the contracting party is in default of payment to ESMP, ESMP may block the “ENGADINcard 365” / “PIZcard 365” at any time.
If the “ENGADINcard 365”/“PIZcard 365” is purchased in the online store, the specific payment terms of the respective payment processing partner apply.
Prices and services may be adjusted at any time. ESMP will notify the contracting party in advance and in an appropriate manner of any changes to the rates. If the changes are disadvantageous to the contracting party, he or she may terminate the contract effective as of the date the change takes effect. If he or she fails to do so, he or she thereby accepts the changes. Price changes become effective and binding for the contracting party upon the next invoice. The price of the “ENGADINcard 365”/“PIZcard 365” may change due to a transition to a higher age bracket. The rate applicable to the relevant age bracket on the first day of the respective validity period shall apply.
